What price resistance? In short a great deal. The regulatory apparatus to address equal pay for work of equal value claims is highly contested, subject to parochial variation and has lacked the capacity to consistently address substantive claims. There have been cycles of advances and retreats in the scope and interpretation of regulatory measures. Such cycles, including the reversion to binary, male comparator benchmarks, preclude any uniform trajectory away from ‘equal pay for equal work’ remedies towards those based on recognition of the broader concept of ‘equal value’.
